1. Agreement to Terms
By accessing or using DigitalMeet's video conferencing platform and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you and DigitalMeet ("we," "our," or "us"). If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.
2. Description of Service
DigitalMeet provides a cloud-based video conferencing and collaboration platform that enables users to conduct meetings, share content, and collaborate in real-time. The Service includes features such as video and audio conferencing, screen sharing, recording, messaging, and related functionality.
3. Account Registration and Security
3.1 Account Creation
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account information.
4. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others, including intellectual property rights
- Transmit harmful, offensive, or inappropriate content
- Engage in spam, phishing, or other fraudulent activities
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Use the Service for any illegal or unauthorized purpose
- Impersonate any person or entity
- Collect or store personal data about other users without consent
5. Intellectual Property Rights
5.1 Our Rights
The Service, including its original content, features, functionality, and software, is owned by DigitalMeet and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
5.2 Your Content
You retain ownership of any content you create, upload, or share through the Service ("Your Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and transmit Your Content solely for the purpose of providing the Service to you.
6. Payment Terms
6.1 Subscription Fees
Some features of the Service require payment of fees. You agree to pay all fees associated with your subscription plan. Fees are billed in advance on a monthly or annual basis, as selected during registration.
6.2 Billing and Renewal
Subscriptions automatically renew unless cancelled before the renewal date. You authorize us to charge your payment method for all fees due. If payment fails, we may suspend or terminate your access to paid features.
6.3 Refunds
We offer a 30-day money-back guarantee for new subscriptions. Refund requests must be made within 30 days of initial purchase. After 30 days, all fees are non-refundable except as required by law.
7. Service Availability and Modifications
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time with or without notice. We are not liable for any loss or damage resulting from Service unavailability or modifications.
8. Termination
8.1 Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, your right to use the Service immediately ceases.
8.2 Termination by Us
We may suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms, engage in fraudulent or illegal activity, or for any other reason we deem necessary.
8.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. We may delete your account and data, subject to our data retention policies and legal obligations. Provisions that by their nature should survive termination will survive.
9. Disclaimers and Limitation of Liability
9.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITALMEET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
10. Indemnification
You agree to indemnify, defend, and hold harmless DigitalMeet and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
